1. Agreement to these terms
These terms of service ("Terms") govern your access to and use of brandboostco.pro (the "Site") and the brand systems, identity and positioning consulting services (the "Services") provided by BrandBoost Co Inc. ("BrandBoost Co," "we," "us"). By using the Site or engaging our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
2. What "boost" means here
Throughout this Site, "boost" refers exclusively to the strengthening of a brand system — clearer positioning, a more consistent verbal identity, a more legible visual mark, and better-governed touchpoints. It does not refer to, and BrandBoost Co does not provide, any service that inflates followers, likes, views or engagement metrics, and it is not a form of life coaching, wellness service, or income-generating program of any kind. Any interpretation of this Site's marketing language should be read consistently with this definition.
3. Description of Services
BrandBoost Co provides business-to-business consulting services including, without limitation: brand discovery and positioning studies; verbal identity and brand voice guides; visual identity and mark systems; AI-enhanced brand research sprints; content direction and touchpoint mapping; and brand governance retainers. The specific scope, deliverables, timeline and fees for any engagement are set out in a separate proposal, statement of work or engagement letter signed by both parties, which takes precedence over these Terms in the event of a direct conflict regarding that engagement.
4. Eligibility and business use
Our Services are intended for businesses and organizations, not for individual consumers seeking personal, non-commercial brand advice. By engaging us, you confirm that you are acting on behalf of a business or organization and that you have authority to bind that entity to these Terms and to any related engagement agreement.
5. AI-assisted research; human judgment
Our AI-enhanced brand research sprint and related services use artificial-intelligence tools to accelerate research tasks such as competitor scans and category-language analysis. All strategic recommendations, positioning claims, brand voice decisions and visual mark approvals are reviewed and made by a human strategist before being presented as a deliverable. We do not warrant that AI-assisted research is free of error, and we encourage clients to treat AI-generated first drafts as inputs to human review, not as final conclusions.
6. Fees, quotes and payment
Fees for Services are quoted in Canadian dollars (CAD) and are set out in the applicable proposal or engagement letter. Unless otherwise agreed in writing, invoices are due within 15 days of issue. We reserve the right to pause work on an active engagement where payment is significantly overdue, after reasonable written notice. Prices shown on the Site for general service ranges are illustrative and subject to confirmation once scope is defined.
7. Intellectual property and deliverables
Except as otherwise agreed in an engagement letter, BrandBoost Co retains ownership of pre-existing methodologies, templates and internal tools used to produce deliverables. Upon full payment for a completed engagement, ownership of the specific deliverables created for your business — such as a finalized logo file, brand voice guide, or positioning document — transfers to you, subject to any third-party licensed material (such as licenced stock photography or typefaces) identified in the deliverable, which remains subject to its original licence terms.
We may, unless you request otherwise in writing, reference completed engagements in an anonymised or client-approved form in our own portfolio and marketing materials, including on the Work page of this Site.
8. Client responsibilities
You agree to provide timely, accurate information and feedback needed to complete an engagement, to hold necessary rights to any material you provide to us for use in deliverables, and to review draft deliverables within the timeframes set out in the applicable engagement letter. Delays in providing feedback or approvals may extend project timelines correspondingly.
9. No guaranteed outcomes
Brand systems influence how a business is perceived and understood; they do not guarantee any specific business result, including but not limited to sales growth, follower or engagement growth, media coverage, or competitive outcomes. Results depend on many factors outside our control, including market conditions, execution by your team, and consistent application of the specimen board we provide. Nothing in our marketing, proposals or Services should be read as a guarantee of any such outcome.
10. Disclaimer of warranties
The Site and Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, BrandBoost Co disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, in connection with the Site and Services.
11. Limitation of liability
To the maximum extent permitted by law, BrandBoost Co Inc. and its directors, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunity, arising from or related to your use of the Site or Services. Our total aggregate liability arising from any engagement is limited to the fees actually paid by you to BrandBoost Co for the specific engagement giving rise to the claim, except where such limitation is not permitted by applicable law.
12. Indemnification
You agree to indemnify and hold harmless BrandBoost Co Inc. from any third-party claims, losses or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or material you provide to us that infringes the rights of a third party.
13. Termination
Either party may terminate an active engagement in accordance with the termination provisions of the applicable engagement letter. In the absence of a specific provision, either party may terminate an ongoing retainer with 30 days' written notice. Termination does not relieve you of the obligation to pay for Services already performed.
14. Not life-coaching or financial advice
For clarity, and consistent with our FAQ, BrandBoost Co is a brand systems consultancy. We do not provide life coaching, wellness, therapeutic, financial, legal, tax or investment advice, and nothing in our Services should be construed as such. If you require advice in those areas, please consult an appropriately licensed professional.
15. Governing law and disputes
These Terms, and any dispute arising out of or relating to the Site or Services, are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that the courts located in Vancouver, British Columbia, will have exclusive jurisdiction over any dispute not otherwise resolved by agreement between the parties.
16. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Site or Services after changes take effect constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
